For individually created self-drive tours we reserve the rights to charge  a non refundable deposit of min. 10 %  of the tour price.

For self-drive tours , the following cancellation fees apply:
until 42 days prior to departure: : 50,00 AUD per person
from 41 days to 29 days prior to departure : 15 % cancellation fee
from 28 days to 15 days prior to departure : 35 % cancellation fee
from 14 days to 8 days prior to departure    : 50 % cancellation fee
from 7 days prior to departure : 80 % cancellation fee
no show  : 100 % cancellation fee

With this new tariff all previous tariffs lost their validity. Subject to errors and misprints.

 

General Conditions

CONTRACT PARTNERS:

BOOKINGS AND PAYMENTS:

Bookings do not require a deposit. Full payment has to be received by our office latest 28 days prior the date of tour departure in our account. Bookings made within the 28 days prior to departure require immediate full payment. A fax copy of the transfer order form from your bank is required at the time of booking and payment. Without prior payment regardless of which reason we will not enter into a contract and will not transport or accommodate customers.

GENERAL:

All our prices are subject to revision without prior notice unless a price or the above companies to a certain date with the exemption of government directed increases (for example GST) or fuel prices have validated price list. The right is reserved to decline, to accept or retain any person as a passenger on any tour. If a passenger behaves in a bad manner in regards to the country in which he/she travels in and has been told not to do so the above companies have the right to exclude this person from any further travel arrangements at the persons own expense.

RESPONSIBILITIES AND LIABILITY:

APTS and their agents cannot be held liable for any alterations which may occur in the timetable of services other than those owned and operated by the Companies for any reason whatsoever. Should passengers incur additional expenses it is the responsibility of each passenger. The companies shall be exempt from all liability in respect of detention, delay, loss, damage, sickness or injury, however and by whomsoever caused and whatever kind occurring of or to the passenger at any time when the passenger is not on board the carrier of conveyance used or operated by the companies. The passage contract used by the companies shall constitute the sole contract between them and the purchaser of these tours/services and/or passengers. All tickets, deposit tickets, coupons and orders are furnished and issued subject in all respects to those terms and conditions under which the means of transportation of other services provided thereby are offered or supplied by owners, operators, public carriers, managing agents. The companies are not liable for and deny all responsibility for personal injury or property damage arising out of these activities, whether caused by circumstances within or without control. The Companies reserve the right to amend, make variations to or cancel the tours, accommodation, transport or other services and facilities advertised in this brochure in regards to unforeseeable events such as natural disasters, overbooking situations, strikes, any political events, weather changes, fire etc. The amendments will be made in the best way possible i.e. a choice of hotels of the same category, transportation in a similar way and the direction. The minimum and maximum number of participants to operate any specific tour is always quoted in the itinerary or will be advised by the companies on request. These conditions cannot be varied or altered or waived by any personal providing services or facilities. The companies will not be bound by representation purported to have been made on its behalf unless they confirm or have confirmed or made representation in writing. The companies reserve the right to utilize hotels other than those named in these itineraries and to alter itineraries to suit amended hotel reservations. They finalize all arrangements upon the express condition as set out herewith. As the arrangement for each entire tour as specified in the itineraries represents a "COMPLETE" package of arrangements, an itemization of costs will not be rendered. Bookings are only accepted on these conditions and responsibilities as outlined above. Because many of our tours are operated in vast and rarely populated areas, we have to accept certain situations of specific local or technical natures. In the case of weather conditions or other conditions which are not in our influence such as technical problems, fires, strikes or any other unforeseeable problems which could cause boats not to leave the harbor or will cause a change of the planned itinerary or a change of inclusions in the specific tour we will be changing the itinerary to a same or higher standard level. If the contract gets cancelled during the travel time we don’t pay any refund in parts or full amount. Any additional costs have to be paid by the client. The clients have no entitlement to a refund (including a complete cancellation) - therefore we reserve the right to change an itinerary even without notice. There is no financial compensation whatsoever for delays. Our staff is not entitled to make any special agreements with a client without the consent of the Managing Director or his authorized person. The participation in our tours is always on the clients own risk. The clients take responsibility in regards to visa, customs, health and legal requirements.

On our selfdrive tours all travel is at clients own risk. We accept no responsibility for any mistakes, inaccuracies or mis-descriptions, whether by inclusion or omission and whether negligent or otherwise.

SMOKING:

Smoking inside rental vehicles is prohibited by Australian Government regulation.

GPS navigation unit:

The copyright of the software is held under American, European, Australian and Taiwan laws. We are obligated to report any proven unauthorized use or copy of the software and loss of the GPS unit in order to replace the software license held. We are required to name the user (or hirer) who attempted the unauthorized use!

Bookings will only be accepted in regards to the above conditions. Any prior conditions are not valid any more. If one or more conditions in this contract are ineffective this does not automatically effect the whole contract.
